General Eligibility for TN Visas

Among the types of professionals who are eligible to seek admission as TN nonimmigrants are accountants, engineers, lawyers, pharmacists, scientists, and teachers. You may be eligible for TN nonimmigrant status if you meet all of the following criteria:

  • You are a citizen of Canada or Mexico (cannot be a permanent resident)
  • Your profession qualifies under the regulations
  • The position in the United States requires a NAFTA professional
  • You have a prearranged full-time or part-time job with a US employer (does not include self-employment)
  • You must have proof of intent to return to your permanent residence at the expiration of your temporary TN Visa stay

If you are a Mexican citizen, then you are required to obtain a visa to enter the United States as a TN nonimmigrant. Unlike Mexican citizens, Canadian citizens are generally eligible for admission as nonimmigrants without a visa. The TN category, a nonimmigrant classification, simply reflects this general exemption from the visa requirement. NAFTA governs which evidence is required to prove whether a Canadian or Mexican citizen is a professional in a qualifying profession.

TN General Professions & Required Qualifications

Accountant

TN Visa Accountant

Job Description. In general, an accountant helps investors, managers, tax authorities, and others with resource allocation. An accountant typically analyzes financial information for financial reports or maintains the record of an organization’s assets, liabilities, profit, loss, tax liability, or other financial activities.

Qualifications. To apply for a TN Visa as an Accountant, the applicant must meet the general eligibility requirements and have one of the following:

  • A Baccalaureate or Licenciatura Degree in Accounting or a closely related field
  • A C.P.A., C.A., C.G.A., or C.M.A.

TN Visa Architect

Job Description. In general, an architect is a professional trained in planning, designing, and overseeing the construction of buildings and other structural properties with the main purpose of human use or occupancy.

Qualifications. To apply for a TN Visa as an Architect, the applicant must meet the general eligibility requirements and have one of the following:

  • A Baccalaureate or Licenciatura Degree in Architecture or a closely related field
  • A state or provincial license

TN Visa Computer Systems Analyst (CSA)

Job Description. In general, a computer systems analyst analyzes science, engineering, business, and other data processing problems to develop and implement solutions to complex applications problems, system administration issues, or network concerns. They also perform systems management and integration functions, improve existing computer systems, and review computer system capabilities, workflow, and schedule limitations. They may also analyze or recommend commercially available software.

Qualifications. To apply for a TN Visa as a Computer Systems Analyst, the applicant must meet the general eligibility requirements AND provide proof of one of the following qualifications:

  • A Baccalaureate or Licenciatura Degree in IT, Computer Systems, or a closely related field
  • A Post-secondary Diploma which refers to a credential issued by an accredited academic institution in Canada or the United States on completion of two (2) or more years of post-secondary education AND have three (3) years of related IT experience
  • A Post-secondary Certificate which refers to a certificate issued by the federal government of Mexico or a state government in Mexico, an academic institution recognized by the federal government or a state government, or an academic institution created by federal or state law on completion of two or more years of post-secondary education at an academic institution AND have three (3) years of related IT experience
